Pogodba o služnosti je pogodba, s katero pogodbene stranke ustanovijo pravico služnosti, ki je pravica služnostnega upravičenca uporabljati stvar ali izkoriščati pravico služnostnega zavezanca oziroma zahtevati od lastnika stvari, da opušča določena dejanja, ki bi jih sicer imel pravico izvrševati na svoji stvari (služeča stvar).
